Expert: unconvicted candidates can get parliamentary seats

Diyala, March 14 (AKnews) - A legal expert said Saturday that the detained non-convict candidates can obtain seat in the Iraqi parliament.

The criteria for candidacy identified by the electoral commission can be summed up by not including the candidates subject to the procedures of the Accountability and Justice Law and the Integrity Committee.

And as long as a candidates are not subject to the law and the committee, they have the right to compete and gain membership of the parliament if the Iraqi judiciary didn't indict him, major general jurist Hussein al-Tamimi said Saturday referring report that a detained candidate who was charged with legal Article 4 of terrorism in Diyala province.
 
Iraqi rmedia reported earlier that a National Dialogue Front candidate who is also a member of the provincial council in Diyala, Najem Al-Harbi – wnad who is currently under arrest - has gained more than 11 thousand votes and came in the first place on the Iraqiya list in Diyala province.

"Iraqi law is clear and explicit and asserts that the accused is innocent until a decision is taken about the charges against him, the law guarantees all the rights including the candidacy to the parliament." Al-Tamimi added.

Meanwhile, an official security source refused to give details about the charges against Harbi, saying only that he "charged in accordance to Article 4 of terrorism and has been transferred to Baghdad."

A security force from the anti-terrorism regional regiment had arrested the head of the national dialogue in Diyala provincial council Najem Al Harbi before the beginning of the electoral campaigning and took him to their headquarters and then to Baghdad for allegedly supporting the armed groups when he was administrating Muqdadiyah city that witnessed sectarian tension in the cities of Diyala province in 2006-2008
